Short quoted phrases are from federal and state law and from United States government web pages. Nothing is taken from a state driver manual, a prep company, a course provider or another practice test.

How it works

This unofficial practice bank holds 174 questions on alcohol, drugs and driving, the part of a permit test that turns on numbers. Of these, 77 are national, written from federal law and named federal agency pages, and 97 come from the statutes of ten states. Choose a subject or your state under Start from, or press Exam mode for a mixed set of 40.

The ideas every alcohol question turns on

In federal highway law, Title 23, section 163 describes a per se law at 0.08 percent, where the reading itself makes the offense, and section 161 describes a 0.02 percent standard for drivers under 21. Title 49, section 382.201 bars a commercial driver from safety-sensitive duty at 0.04. The other national topics cover how alcohol affects driving, standard drinks, sobering up, drugs and medicines, open containers and commercial drivers.

Where the ten states differ

All ten states put the adult per se figure at 0.08, but their under-21 rules differ. California uses 0.01 percent, Texas any detectable amount, Florida and Pennsylvania 0.02, New York .02 to .07, Illinois anything above 0.00, North Carolina any alcohol remaining in the body, and Ohio and Virginia 0.02 up to 0.08. Michigan counts the same range, or any presence of alcohol from drinking. A first refusal of the chemical test costs one year in California and 180 days in Texas.

A study order that starts with the numbers

Begin with BAC and the legal limits, then open your own state under Start from. Take Standard drinks and the body next. The national alcohol institute's standard drink holds about 0.6 fluid ounces of pure alcohol: 12 ounces of regular beer, 5 ounces of wine or 1.5 ounces of 40 percent spirits. Follow with the sobering up and drug topics. Then press Exam mode for 40 mixed questions with no pass mark and no clock. Forty is this site's number, not any state's.

  • Learn each federal figure with its driver: 0.08 percent per se for any driver, 0.02 under 21, 0.04 for a commercial driver on duty. Then add your own state's under-21 figure.
  • Size is not strength. The national alcohol institute counts a 12-ounce beer at 5 percent alcohol as one standard drink and at 10 percent as two.
  • The same institute says nothing speeds the brain's recovery from alcohol: not coffee, a shower or a morning drink. It also says BAC can keep rising after the last drink.
  • Implied consent means the consent to chemical testing was given by driving. Refusing carries its own license penalty: in Illinois a first refusal brings twelve months against six for a failed test.

Questions and answers

Is this an alcohol and drug practice test for Florida's first-time driver course?

No. Florida's traffic law and substance abuse education course is a separate thing, and this page is no part of it. Under Florida Statutes 322.095, outside providers submit those courses and the state approves them. Finishing this bank earns no certificate. The Florida topic holds 13 questions on the state's own alcohol statutes.

Are these the DMV permit test alcohol questions I will see on test day?

No. No motor vehicle agency wrote or reviewed them, and none is a real test question. Each was written for this site from a statute or a named federal agency page, which the source line links after you answer. Use the bank alongside your state's driver manual, not in place of it.

Which DMV questions about alcohol change from state to state?

Not the adult figure, which is 0.08 in all ten states here, though the national traffic safety agency notes that Utah uses .05. What changes is the under-21 figure, the suspension for refusing a chemical test and the open container details. Texas leaves a locked glove compartment out of the passenger area, while Virginia counts an unlocked one as part of it.

Does this page tell me how much I can drink before driving?

No. The national traffic safety agency says it is very difficult to assess your own BAC: the reading depends on the number of drinks, how fast you drink, your sex, your weight and food in your stomach. It adds that even a small amount of alcohol can affect driving ability. This bank has no drink counter and is not medical or legal advice.

How current are the questions?

Every source was read on September 19, 2026. Two federal agency pages are old: the drugged driving fact sheet is dated December 2019, and the alcohol and medicines brochure was last revised in 2014. The New York and Ohio sections were read on copies, not on those states' own sites. If an answer disagrees with today's statute, the statute is right.
