What the exam covers

The state's Bail Bonds outline has five parts: Delaware statutes and regulations on bail and bail agents, insurance ethics, bail bond procedures, fiduciary responsibilities and definitions.

Two kinds of bail agent

A surety bail agent is appointed by a surety insurer and attaches a copy of its power of attorney to each bond. A property bail agent pledges cash or other property and files a sworn statement of assets and liabilities (18 Del. C. 4332, 4333B, 4351).

What is left out

Law only. Outline lines that no section states, such as kinds of agency authority, errors and omissions insurance and dictionary definitions, are not asked.

  • A license is suspended automatically whenever the agent's bond is not in force (18 Del. C. 4336).
  • Never suggest or name an attorney to a defendant (18 Del. C. 4350).
  • Cash collateral over $5,000 goes to the insurer at once, and collateral stays in Delaware (18 Del. C. 4348).

Questions and answers

How many questions are on the Delaware bail bond agent exam?

The Bail Bonds content outline lists 50 questions, and the candidate handbook gives the DE Bail Bond Agent exam one hour. The handbook says some exams need a scaled score of 70 and others 80, and that the score report names the passing score.

How do I become a bail bondsman in Delaware?

Pass the written examination, then apply to the Insurance Commissioner: age 18, a Delaware office, fingerprints for state and federal record checks and a $50,000 bond. Register with the courts before writing bonds (18 Del. C. 4333, 4336, 4337, 4345).

How much do bail bondsmen charge in Delaware?

On a surety bail bond over $1,000 the filed premium is at least 5% and at most 10%. A property bail agent's charges for cash bail are 20% to 30% of the bail posted (18 Del. C. 4347).

Can a felon be a bail bondsman in Delaware?

No. An applicant must not have pleaded guilty to or been found guilty of a felony, and the Commissioner permanently revokes the license of a bail agent found guilty of one (18 Del. C. 4333(c)(3), 4354(c)).
