How it works

Colorado gives no separate bail exam: a bail bonding agent is an insurance producer with the Casualty line. This unofficial Colorado bail bond agent practice test asks 60 questions on bail statutes. Not affiliated with the Colorado Division of Insurance.

Where bail sits in the Casualty exam

The Casualty examination's Colorado outline lists Bail Bonds among the statutes pertinent to casualty insurance only, citing C.R.S. 10-2-705 and 10-2-707: the bail bond documents and the price limits.

Numbers the statutes set

Judgment comes 35 days after a forfeiture is entered when no hearing is asked for, then execution is stayed 91 days. A bond is exonerated three years after posting when no judgment was entered (C.R.S. 16-4-114, 16-4-110).

Three kinds of bonding agent

The criminal procedure code counts an insurance producer, a cash-bonding agent and a professional cash-bail agent as bail bonding agents. The last two post a qualification bond of at least $50,000 with the Division (C.R.S. 16-1-104, 10-23-105).

  • Give the disclosure statement before taking any payment or collateral (C.R.S. 10-2-705).
  • Return nonforfeited collateral within 14 days of the court order releasing the bond (C.R.S. 18-13-130).
  • An unpaid forfeiture judgment puts the agent on the board: no new bonds anywhere in the state (C.R.S. 16-4-114).

Questions and answers

Is there a bail bond agent exam in Colorado?

Not under that name. The state's candidate handbook asks a person who writes bail for the Casualty line of authority, and it allots the Casualty examination two hours.

How do I become a bail bondsman in Colorado?

Hold a producer license with the Casualty line, then complete eight clock hours on bail bonding and 16 on bail recovery practices before a bail insurance company appoints you by written contract (C.R.S. 10-2-415.5).

How much do bail bondsmen charge in Colorado?

No more than the greater of $50 or 15 percent of the bail. The only other fees allowed are a court or law enforcement bond filing fee, the actual cost of storing collateral, and premium financing (C.R.S. 10-2-707).

What happens when a defendant misses court on a Colorado bail bond?

The court may declare the bond forfeited, and notice goes out within 14 days. The surety has 14 days from receipt to ask for a hearing. If the defendant appears before judgment, the forfeiture is set aside and the bond exonerated (C.R.S. 16-4-114).
