What the real exam holds

The outline has three parts: Montana statutes and rules common to all lines of insurance, 10 questions; statutes and rules pertinent to title insurance, 7; and title insurance terms and related concepts, 18.

What is asked here, and what is not

The first two parts are asked from the sections the outline cites, with rules 6.6.2201 to 6.6.2203. From the third part, only what Montana's code defines is asked: estates, deeds, easements, recording, liens, mortgages and trust indentures. Policy schedules, endorsements and other textbook terms are left out.

  • Bank charges never come out of a trust account; a deduction is made good within one business day (ARM 6.6.2202).
  • A financial interest starts at 1 percent; a banned referral fee brings liability of three times the charge (Sections 33-25-105, 33-25-402).
  • Trust indentures cover tracts up to 40 acres; a trustee's sale leaves no redemption and no deficiency (Sections 71-1-304, 71-1-317, 71-1-318).
