What the real exam holds

The Department's Series 13-16 outline weights five parts: insurance regulation 12 percent, general insurance 8, real property 26, title insurance 30, and title exceptions and clearing title 24.

What is asked here, and what is not

Every question rests on a Nebraska statute: the Title Insurers Act, the Title Insurance Agent Act, the Insurance Producers Licensing Act, the unfair practices and fraud acts, and the deed, recording, trust deed, judgment and construction lien statutes. Policy forms, legal descriptions, search technique and general insurance theory are not public law and are not asked.

  • Escrow funds go into a separate fiduciary trust account by the close of the next business day (Section 44-19,116).
  • Marketable record title takes a 22-year recorded chain and possession; an old claim needs a notice filed within 23 years (Sections 76-288, 76-290).
  • A trustee's sale leaves no right of redemption, and a deficiency suit must start within three months (Sections 76-1010, 76-1013).
