What the real exam holds
The Arkansas Title content outline has two parts and prints no weights: statutes and rules common to all lines of insurance (the commissioner, licensing, producer responsibilities) and those common to title insurance only (policies, coverages and forms; exclusions, conditions and stipulations; title searching and examinations).
What is asked here, and what is not
The title part is asked from the Arkansas Title Insurance Act and the Department's title insurance rule, 23 CAR part 204. Searching and clearing title are asked from Title 18: deeds, recording, adverse possession, mortgage satisfaction, mechanics' liens and statutory foreclosure. Policy forms are not asked, and the all-lines licensing sections are on the Arkansas life and health page.
- A title search covers at least the last 30 years; the insured's only remedy for a missed defect is a policy claim (Section 23-103-408).
- Only the title insurer issues closing protection; the agency offers it and takes the parties' election in writing (Section 23-103-405; 23 CAR 204-113).
- A lien account is filed with the circuit clerk within 120 days, after 10 days' notice to the owner (Sections 18-44-114 and 18-44-117).
