How this list was compiled: Written from Texas Government Code chapter 406 (https://statutes.capitol.texas.gov/Docs/GV/htm/GV.406.htm) and Civil Practice and Remedies Code chapter 121 (https://statutes.capitol.texas.gov/Docs/CP/htm/CP.121.htm) as the Texas Legislature publishes them, and from Title 1, Part 4, chapter 87 of the Texas Administrative Code as the Office of the Secretary of State publishes it (https://texas-sos.appianportalsgov.com/rules-and-meetings?chapter=87&interface=VIEW_TAC&part=4&title=1), all read 2026-10-13. 9 questions restate the transcripts of the Secretary of State's four notary training videos (https://www.sos.state.tx.us/statdoc/edinfo.shtml) and 3 its guide to the traditional notary application, revised 12/16/2025 (https://www.sos.state.tx.us/statdoc/guides/TraditionalNotaryApplication.pdf), read the same day; each of those says so in the question. Licence: Own work. What the Texas notary course covers

The Secretary of State's course is four videos: what a notary is, how to perform a notarization, the types of notarial acts, and notary compliance. Video 1 names the law a Texas notary works under: the same two statute chapters and rule chapter these questions cite.

Two Texas rules new since September 2025

Senate Bill 693 made it a Class A misdemeanor to notarize knowing the signer did not personally appear, and a state jail felony when the document transfers real property (Gov't Code 406.0091). It also set record keeping at ten years from each notarization (406.014(g)).

  • A $10,000 bond payable to the governor, and a term of four years from the day of qualifying (Gov't Code 406.010, 406.002).
  • The seal shows "Notary Public, State of Texas" around a five-point star, with the name, identifying number and expiration date (406.013).
  • No identification number and no fingerprint goes in the record book (1 TAC 87.50).

Questions and answers

Is there a test to become a notary in Texas?

Yes, for applications from January 1, 2026. Under 1 TAC 87.8 an applicant takes the Secretary of State's course and must answer at least 70% of its questions correctly. The office's application guide allows 30 minutes for the assessment that follows the videos.

Are these the real Texas notary test questions?

No. This site has never seen the state's assessment and is not affiliated with the Texas Secretary of State. Every question was written from the Texas statutes, the notary rules or the office's published course. No commissioned Texas notary has reviewed the answers yet.

How many questions are on the Texas notary test?

Neither the rules nor the Secretary of State's application guide prints a question count, so this page gives none. An exam set here is 25 questions, a size this page chose.

How many times can you take the Texas notary test?

No more than 3 times in a 3-month period (1 TAC 87.8(e)). Each attempt costs a separate, nonrefundable $20 (87.5), and the course must be taken within 90 days of paying (87.8(d)).

How much can a Texas notary charge?

Up to $10 for the first signature on an acknowledgment and $1 for each one after it, $10 for an oath and $10 for a notarial act not otherwise listed (Gov't Code 406.024). An online notarization may add up to $25 (406.111).
