What the West Virginia part of the exam asks

Of its 40 scored questions the outline gives 17 to the Commissioner, definitions, licensing and producer pay, 6 to unfair trade practices and 8 to automobile insurance. Most of the rest are single questions: insurable interest, binders, rates and forms, the FAIR plan, the guaranty association, malpractice policies and homeowners insurance.

Property and casualty law that is West Virginia’s own

A fire policy on real property is a valued policy. An auto policy two years old may be refused renewal only for listed reasons, unless the insurer chose the one percent method. A third-party claimant's only remedy for an unfair claim practice is a complaint to the Commissioner. The Commissioner's rules are not asked.

  • Auto cancellation takes 30 days' notice, 14 for unpaid premium; nonrenewal takes 45 (33-6A-1, 33-6A-4).
  • A binder may be oral; past 90 days it needs the Commissioner's written approval or a rule (33-6-18).
  • The guaranty association pays up to $300,000 a claim and $10,000 of unearned premium; workers' compensation benefits are paid in full (33-26-8).
