Registration and agency license

An individual investigator holds a registration and an identification card and must be employed by a licensed agency, even as its sole proprietor. The agency holds a Class A license, or Class C when it also provides security (24 Del. C. § 1302; regulation 13.0).

What is left out

The firearms qualification rules written for armed guards, security guard training and testing, and the armored car and canine provisions.

  • Report an arrest to the Board within 5 days, not counting weekends and holidays (24 Del. C. § 1310).
  • A Class A agency sends its roster by the tenth of January, April, July and October (regulation 11.1).
  • Changing agencies voids the old identification card; a new one is issued for the new employer (regulation 8.1).

Questions and answers

Is there an exam for a Delaware private investigator license?

No. 24 Del. C. § 1316 gives an investigator the qualifications of a security guard plus a minimum age of 21, and the training course and test in the Board's regulation 4.0 are for security guards only.

How do I become a private investigator in Delaware?

Be at least 21, with no disqualifying conviction, and be employed by a licensed agency. The Professional Licensing Section's page has applicants fingerprinted first and then email the application; an approved applicant is mailed an identification card.

What does it take to open a private investigative agency in Delaware?

An owner at least 25 with 5 years of investigative experience or police service, a Class A license approved by the Board, a $10,000 surety bond ($5,000 for a sole proprietorship) and $1,000,000 of liability insurance (24 Del. C. §§ 1318 and 1319; regulation 13.1).

Can a private investigator carry a gun in Delaware?

Not on the registration alone. A concealed deadly weapon takes a concealed deadly weapons permit, and any weapon must be one the Board has approved, with training by a board-approved instructor (24 Del. C. § 1321).

How long is a Delaware private investigator license good for?

The identification card expires on the holder's fifth birthday after it is issued (24 Del. C. § 1324). An agency license expires 2 years from the last day of the month it was approved (regulation 13.5).
