Three adjuster exams
The outlines are Independent and Staff Adjuster P/C and W/C Insurance, Series 18-40, the same exam excluding workers' compensation, Series 18-41, and Public Adjuster Insurance, Series 18-39.
The part asked here
Insurance Regulation is 2 of the 50 items on the staff and independent exams and 6 of 50 on the public adjuster exam: licensing, discipline, records and claim settlement law. The topics here follow that part. Insurance basics and policy forms are not asked.
Timed like the real exams
The timed test takes the exams' 50 questions and 1 hour, all on the law.
An insured may rescind a public adjuster contract within 3 business days; anything of value comes back within 15 business days (NMSA 59A-13-15).
An adjuster who is also a contractor may not adjust a loss on a property the adjuster works on (NMSA 59A-13-13).
In a catastrophic disaster a public adjuster's fee may not exceed 10 percent of the insurance settlement (13.4.8.17 NMAC).
Questions and answers
How many questions are on the New Mexico adjuster exam?
50 items in 1 hour on each of the three exams: Series 18-40 (property, casualty and workers' compensation), Series 18-41 (excluding workers' compensation) and Series 18-39 (public adjuster), by their content outlines.
Who needs an adjuster license in New Mexico?
Anyone who acts as an adjuster in the state, and anyone anywhere who adjusts workers' compensation claims of claimants resident or located in New Mexico (NMSA 59A-13-3). Attorneys adjusting incidentally, agents on their own insurer's policies and appraisers who only estimate damage are not adjusters.
Is a New Mexico staff adjuster license different from an independent adjuster license?
Yes. A staff adjuster is an insurer's salaried employee, must be appointed by an insurance company and needs no evidence of financial responsibility. The license ends automatically if no new appointment is reported within 30 days after one ends (13.4.8.15 NMAC).
Is this New Mexico adjuster license practice test free?
Yes. All 91 questions are open, and your answers stay in your browser. The questions were written for this page from the law itself; none comes from the state exam, and the New Mexico Office of Superintendent of Insurance did not write or review them.
