How this list was compiled: Florida Statutes (2026), Chapter 468, Part VI, sections 468.381 to 468.399, with section 672.328 (sale by auction) and section 455.224 (citations), read on October 12, 2026 one section at a time on the Florida Legislature's site (https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0400-0499/0468/0468PARTVIContentsIndex.html), and the rules of the Florida Board of Auctioneers, Chapter 61G2, Florida Administrative Code, read the same day on the Department of State's rules site (https://flrules.org/gateway/Division.asp?DivID=272). The topics follow the Candidate Information Booklet for the Auctioneers' Licensure Examination, effective February 2025, which the Florida Department of Business and Professional Regulation publishes at https://www2.myfloridalicense.com/servop/testing/documents/auc_cib.pdf. Each question names its section or rule and links to it. Licence: Own work. Every question, wrong choice and explanation was written for this site from the text of the law. The seven subjects of the Florida auctioneer exam

The department's Candidate Information Booklet, effective February 2025, spreads the examination over seven subjects: advertising 20 percent, legal 18, financial aspects 18, conducting the sale 15, appraisal 14, merchandising 8 and soliciting 7.

What is left out

Appraisal and merchandising rest on auction school texts, not on a statute, so they are not asked. The five topics here are the subjects the law speaks to, in close to the booklet's shares.

Where the answers come from

Chapter 468, Part VI of the Florida Statutes, the sale by auction section of the Uniform Commercial Code (s. 672.328) and the board's rules in Chapter 61G2, Florida Administrative Code, all read on October 12, 2026.

  • Proceeds not settled at once go into escrow within 2 working days (s. 468.388(10)).
  • Every advertisement carries the name and Florida license number of the auctioneer and the auction business (s. 468.388(11)).
  • A sale is with reserve unless the goods are put up without reserve in explicit terms (s. 672.328).

Do you need a license to be an auctioneer in Florida?

Be at least 18, serve one year or more as a licensed apprentice or complete an 80-hour course that meets board standards, pass the written examination and be approved by the board (s. 468.385).
