How this list was compiled: West Virginia Code Chapter 19, Article 2C (Auctioneers), Sections 19-2C-1 to 19-2C-10, and Section 46-2-328 (sale by auction), read on October 15, 2026 on the West Virginia Legislature's code site (https://code.wvlegislature.gov/19-2C/); and Legislative Rule Title 61, Series 11B (Auctioneers), effective April 25, 2022, read the same day in the Secretary of State's final file (https://apps.sos.wv.gov/adlaw/csr/ruleview.aspx?document=17534). The examination's parts and pass mark are from Section 19-2C-5a and from the West Virginia Department of Agriculture's Auctioneer License page (https://agriculture.wv.gov/licenses/auctioneer-licenses/auctioneer-license/). Each law question names its section and links to it; each math question is arithmetic on the numbers it gives. Licence: Own work. Every question, wrong choice and explanation was written for this site from the text of the code and the legislative rule, and the math questions use made-up figures. Nothing comes from the state examination, a testing service, a prep course or an exam question pool.

What the West Virginia auctioneer exam asks
Section 19-2C-5a gives the auctioneer's examination a written and an oral part and the apprentice's a written part only. Rule 61-11B-8 says the written part tests the Auctioneer Law, the rules under it and other fundamentals of the profession. The department gives it in April and October.
What is left out
The oral examination, and fundamentals that rest on no statute. The department publishes no question count and no time limit, and none is given here.
Where the answers come from
Sections 19-2C-1 to 19-2C-10 and 46-2-328 of the West Virginia Code, and Series 11B of Title 61, effective April 25, 2022, read on the Legislature's and the Secretary of State's sites on October 15, 2026.
The written contract is made in duplicate before the auction and kept three years from final settlement (Section 19-2C-9).
Sale money goes into escrow within 24 hours or on the first business day after the sale (Section 19-2C-9a).
An auction with a minimum opening bid may not be advertised as absolute (Section 19-2C-10).
Questions and answers
What score do you need to pass the West Virginia auctioneer exam?
70 percent out of 100 on each part, written and oral. An applicant who fails either part is not licensed and waits for the next regularly scheduled examination (Section 19-2C-5a).
How do you become an auctioneer in West Virginia?
Be 18 and a United States citizen, serve a two-year apprenticeship, or six months after an approved auction school, conduct six supervised sales, file a $25,000 bond and pass the written and oral examinations (Sections 19-2C-5, 19-2C-6, Rule 61-11B-4).
Do you need a license to be an auctioneer in West Virginia?
Yes, from the Commissioner of Agriculture. Exceptions include an owner personally selling his or her own property who has held no auction in the past 12 months, sales under a deed of trust, and unpaid charity auctions (Section 19-2C-2).
When does a West Virginia auctioneer license expire?
On June 30 of each year. Renewal takes the $100 annual fee and six hours of continuing education, and a license expired for more than two years needs the written and oral examination again (Section 19-2C-3, Rules 61-11B-6, 61-11B-16).
