How this list was compiled: Our own questions on the Uniform State Content area of the SAFE MLO National Test with Uniform State Test Content Outline, published in the MLO Testing Handbook of the NMLS Resource Center (https://mortgage.nationwidelicensingsystem.org/knowledge/products/nmls/pubs/testingHbk/education/mlo_testing/mlo_test_faq/mlo_testing_hbk_testOutline-1.html, read 2026-10-11), which gives that area 11% of the test. Every answer was read on 2026-10-11 in one of the two federal texts the outline lists for it: the S.A.F.E. Mortgage Licensing Act, 12 U.S.C. 5101 to 5117, in the United States Code, 2024 edition, as published by the Government Publishing Office (https://www.govinfo.gov/content/pkg/USCODE-2024-title12/html/USCODE-2024-title12-chap51.htm), and Regulation H, 12 CFR part 1008 with its appendices A to D, as shown on the eCFR (https://www.ecfr.gov/current/title-12/part-1008, text dated 2026-10-01, the same as the text current through 2026-10-08). Each question names the section its answer was read from and links to it. Licence: Questions, choices and explanations are original work of this site. The statute and the regulation they describe are works of the United States Government.

How it works

This unofficial NMLS UST practice test has 89 questions of our own: who must be licensed, getting and keeping a license, regulators and enforcement, the SAFE Act and NMLS. It is not affiliated with NMLS, the Conference of State Bank Supervisors or any state regulator.

What the uniform state content is

The content outline in the MLO Testing Handbook gives Uniform State Content 11% of the SAFE MLO National Test with Uniform State Test. Its heading is the SAFE Act and the state regulators' model state law: who needs a license, qualifications, renewal, NMLS requirements and compliance.

What these questions cover

All 89 answers were read in two federal texts the outline lists: the SAFE Act (12 U.S.C. 5101 to 5117) and Regulation H (12 CFR part 1008). Topics neither text settles, such as advertising and record retention, are left out. Pre-licensing hours, the pass mark and retake waits are asked on the MLO practice test.

Exam mode

The handbook gives no question count for this content area alone. Exam mode here asks 20, our number.

  • Two temporary authority clocks: registered in NMLS during the past year when leaving a bank, licensed elsewhere during the past 30 days when changing States.
  • A processor or underwriter who is an independent contractor needs a license; a supervised employee doing only clerical or support duties does not.
  • Taking an application alone is not enough: the Act's definition also needs offering or negotiating terms for compensation or gain.

Questions and answers

Is this NMLS UST practice test free?

Yes. All 89 questions are free with no sign-up, and your answers stay in your browser.

Is the UST a separate test?

Not in the handbook read on October 11, 2026. It lists one test, the SAFE MLO National Test with Uniform State Test, and uniform state content is one of its content areas.

Do I have to pass the UST again for each state?

No. The handbook's FAQ says the SAFE MLO Test needs to be passed only once, and that passing it meets the state-specific test requirements of state agencies.

Does this cover my state's mortgage law?

No. Every question rests on the SAFE Act and Regulation H, which set the minimum each State's licensing law must meet. For a State's own statute, read that State regulator's material.

Are these real NMLS test questions?

No. Every question is our own, and none is copied or reworded from the real test, its sample questions or a prep course. NMLS is the Nationwide Mortgage Licensing System and Registry, and this site is not part of it.
